Hague Agreement protects Brazilian industrial designs

The Hague Agreement Concerning the International Registration of Industrial Designs has been effective since August 3. The system now permits that a single request, in a single language, protects Brazilian designs in 96 signatory countries.

Texbrasil (Brazilian Textile and Fashion Industry Internationalization Program), carried out through a partnership between ApexBrasil (Brazilian Agency for the Promotion of Exports and Investments) and Abit (Brazilian Textile and Apparel Industry Association), includes sharing information that assist in the performance of companies of the textile industry abroad.

The agreement has provisions for providing to the Brazilian furniture, shoes and apparel, among other, industries better legal security to export their products to member countries of the system, protecting them against illegal copies.

The action encourages foreign investments in Brazil, as it protects the works of parts non-resident in the country, and thus favors the registrations made by Brazilians abroad. It  also sets protection for the ornamental aspects of industrial products, both in terms of shape and printing and patterns applied, and cost reduction by simplifying the procedures necessary for registrations abroad of products with their own design.

Before this system could be approved and become effective, the interested parties had to register applications in each country where they intended to trade products, in the corresponding Intellectual Property offices and in the respective language, and pay the respective charges.
